23 Overland with factory tow package minus the receiver

My question is, is the stock OEM hitch minus the receiver a IV or something smaller, it looks identical to the OEM Mopar one on their site, but stock it does not come with the actual receiver, can I just add this one and safety tow 5,200 lbs, I have attached a pic of the OEM and the MOPAR IV.

Looks like the same Chinese thing quadratec sells and they rate it for 5,000 and 500lb tongue. You never said what the tongue weight of the trailer is. Your truck is rated for 4,500. For slow and short distances I would CONSIDER doing 5,200 with the Mopar hitch but not that thing. Tow package trucks have additional cooling as well as an alternator and Class IV hitch.

Check Facebook marketplace, I got a Mopar tow package hitch from someone who no longer needed theirs, got it for 80 bucks.

The title of your post is odd. There is no such thing as a "factory tow package minus the receiver". The factory tow package come with the Mopar receiver plus other cooling and electrical mods to handle the loads. So if your Overland does not have the Factory tow package spelled out on the window sticker (which it likely doesn't since you don't have a receiver) then adding a Mopar receiver is not going to get your tow rating up to whatever the owners manual states for an Overland with the tow package.

EDIT: After looking at your pictures more closely I now see the structural assembly in your picture do not have a 2"receiver attached to one of them. I understand your title now.

I would get the proper MOPAR type receiver. Also keep in mind, if your Overland doesn't have the tow package, it has the lower output alternator and lower capacity fan, so it's not just a hitch, it's a package.
I tow 5,000 or so, I've gone a bit over with mine, but I'd never do it without the proper cooling fan and alternator to handle the extra load. And I'm not a fan of "bolt on receiver squares.".
You can find the proper receivers.
As already said - if you don't have the factory receiver, you likely don't have the factory tow package unless someone took it off for some stupid reason.

Grab your VIN and look up the window sticker and build sheet - if it doesn't show certain things - you don't have the tow package.

ALL GLADIATORS come with the trailer wiring, even if you don't have the tow package, so that's no indicator of tow package vs. non-tow package -they all have that wiring.

I have the 220 amp alternator and the heavier duty 850 trans.

I have the 220 amp alternator and the heavier duty 850 trans.
240 amp is the tow package alternator, and all gas engine Gladiators have that transmission - or the manual transmission.
The transmission is the standard automatic for the 3.6
You need to look for the tow package in the build sheet or window sticker. You can plug your vin in online and get those.
