Correct. They can sue, regardless. Even if you can prove it's true and it ultimately holds up (or a judge refuses to see it). But the strategy is to make you pay to defend yourself. That's how lawsuits work.

You'll want adjustable LCAs at the very least for a 1.5 spacer. My Mojave was basically level when purchased, but a steel bumper and winch later, a 1.5 was put on. It sits a scoatch high in the front, but am told the weight/wear will eventually bring it down to level. Not sure if that's bunk...
