Brand New 37s Came With 'Cuts/Slashes/Damage' On Sidewall?

21' Jeep Gladiator Rubicon
I just finally got 37s (General Grabber X3 37x12.50r17) for my JTR yesterday and they look great. However, while doing the chalk test I noticed that one of the tires has what appears to be damage already to the thicker part of rubber on the upper part of the sidewall. The other tires are all fine. I can't really tell if came out of the mold like this or if it's damage from something else. The tire doesn't appear to be used.

Is this a big enough deal to take back and have it replaced? I'm sure I'm going to scrape them up anyways but I'd like to be the one to do it, not have them come like that. I got them at @Discount Tire and guessing they'll just replace it even though they had to order them in. I didn't buy the certificates. Any thoughts?

Damaged sidewalls are unsafe. They need to replace it.

Have you checked the inboard side of the other three tires?

Hi. 25 years experience working for a major tire manufacturer. That is definitely a manufacturing flaw. Got past quality control. Someone else mentioned this too. Go back to dealer and get new tire(s).
