I bought a set of maxxis for my old CJ and they are a bit too big after measuring. Is there any chance I can run a 16" wheel with the max tow gladiator and run these 37s on it?

On my old JK sport I ran 15" aluminum wheels and they cleared. The Gladiator may be able to squeeze a 16" on?

I don't believe they will clear the brake calipers.

17's are persnickity on where the wheel weights are positioned so the calipers don't rub them off.

Only 1 way to find out... And you have both sitting right there... Pull one tire/wheel off of the JT, and see if it fits and clears the caliper when it rolls. You never know till you find out. You might prove the narrative/notion wrong.
