I have been a couple accidents (not my fault) and the one thing they never tell you about is a Diminished Value Claim. Pending the outcome of the insurance situation you had mentioned (them no having any but the owner does). If they don't total out the vehicle, you can tell them NOW that you want to also file a diminished value claim. This pays you the difference from the appraised value before and after the accident. They may push back a bit but just remind them that it is their job to indemnify you and that you were innocent here. Offer to take it to multiple dealerships and have them provide written pricing offers for both before and after. And remind them that Carfax offers the same. That usually scares them into being honest.

I would have to say it won't scare them to be honest. Even after taking all the necessary steps, and having the dealerships/shops I went to speak to the agent, they still tried to lowball me at about 60% of what I was asking, which was the median. I tried to be fair and not take the highest price, and they still tried to do me dirty.

Was that gap coverage from the dealer, or from the insurer? Which insurer?

The coverage would replace my vehicle with a new vehicle, same model and options, if totaled within the coverage period. It’s not gap insurance; I had no gap to cover, as I paid cash. That might also be why the coverage was available, come to think of it.
My insurer is American Family via Costco.
They call it, "NEW CAR REPLACEMENT COVERAGE."

Got rear-ended by a new KL ... driver was impaired, doing at least 100mph in the right lane w/ cruise control engage. How do I know? He kept hitting me as I tried to pull off the highway.

JTR is likely totaled as the frame is hecka bent.
Damn that sucks. I would be pissed!!!

This is helpful information. I'll check my contract / bill of sale. I did some checking today, though, and all signs point to "GEICO does not offer vehicle replacement coverage" while other insurers (Liberty Mutual, maybe Allstates, etc) seem to.

EDIT: Gap insurance wasn't selected on the bill of sale. I don't remember them offering it, shame on me. I'll ask for it next time.
Check who you financed through. Here in IN it's mandatory to have gap on a lease so I don't have to worry about it. When I was buying my old car after my lease I asked my insurance if they could provide gap and they said they only could if I used them for the loan. I told them to come down several % to match my other loan quote but they couldn't. I got gap through the other lender or Kia. Either way, it's paid off in 2 weeks :)

Did you insure the of the lift and labor?
I don't know how to insure that, but I've submitted the parts and labor invoice as part of my insurance claim. Since I'd have to re-buy and re-install on a new vehicle if it's a total loss.

Crazy stuff, they have no problem trying to straighten frames these days, low tolerance spec also. We had a rear ended Grand Cherokee that buckled like a peeing cat and they tried to fix it at $26k in repairs. Months of taking it back for door jams, paint runs, paint mismatch, pain in the ass!

Ugh, I hope they don’t try that on me. I don’t have the time or the patience going back and forth to the shop for the next 6 months.
