If they don't pay after Default Judgment, then I put a lien against the business. Would all this work be worth it for a non-attorney, nope. But I have the means to do it and companies need to learn, they can't crap on people because they think they can get away with it.

A special civil part complaint, as far as difficulty goes is simple compared to a Divorce complaint. I don't have to personally severe the Defendant (Normally around $150 to $175), I pay the court $7 and they do it... Instead of $325 to file a Divorce complaint, a special civil part complaint under $20k claim is only $75 to file.

I am an attorney now, I come from a blue-collar background. I didn't become an attorney until I was 47. I worked in a body shop until I left for the Corps.

As far as having to Sue, I gave them multiple chance to fix it, they told me beat feet. If it were you, they would have told you to beat feet we don't care and same for everyone else - That is what is killing this country, not people sticking up for themselves, so they don't get screwed. But I respect your opinion, I just don't agree with it....

I have been divorced. My goal in life is to never have to deal with a lawyer again. I would have let my CC deal with them.

Just a note, I actually hate 99% of attorneys. Most are money hungry, charge you for every second you are on the phone with them, self-entitled types. I do things a little differently than everyone else. I never bill my clients for any emails, calls or texts with them. I own my own law firm, so I can do that, most attorneys work for someone else and have to follow the firms' rules. not me, I like to do the right thing, because it is the right thing to do....

ahh yes, a vertebrae in the back bone of our country. One of few individuals responsible for making sure we all have food on our tables. and you call yourself lowly. I never thought i could witness "too much" humility. your part of dying breed in an ever increasing difficult environment. It takes courage, discipline, and a set of brass ball to keep doing what you do. and there's nothing lowly about that, at least not to me. there's an honor in being a keeper and nurturer of land or a builder. Can't say that about myself. I build weapons of, well whatever level of destruction u can afford. Morally dark grey at best.

I am going to keep the first post updated, so anyone coming on doesn't have to read through the entire thread just to find out the outcome.
I am a Marine first and foremost, when people ask me if I am attorney (in conversation) I tell them, I think of myself as a retired Marine with a licensed to practice law... But I guess it is the Marine in ke that finds stuff like this offensive. Thousands of people put their lives on the line to protect our great way of life, others do generous thinks for people in need. I see many good companies donating to charities and contributing to toys for tots. Those people doxwhat they can, and I appreciate thatore than anyone will ever know. When I see things like that, it makes me proud to have served. BUT on the other hand when I see people or companies taking advantage of people because they just think they can, it boils my blood
I am sure most people on this forum would do the same if they have the means to. I am definitely no different than the majority of us on here. We are here as a community to help each other.

Update:
Today I got a phone call from a Texas attorney asking how we can settle this.

I told him about the website descriptions being deceiving and to generic. I also told him about how I was treated by their claims person "DAnthony" and how he claimed to "know da law" and take or leave his offer (his offer was I pay more money for their mistake).

The attorney was surprised when I said, just send me the right ones and a shipping label to send these back; talk to the owners about the website and inform them on "DAnthony's" conduct. He said that was more than fair and jumped on that offer... I think he was calling to offer me more than just specific performance.

The law says I don't have to accept specific performance (them sending me the right ones) after I gave them the chance and they turned it down. At that point it becomes cover damages and attorney fees (in this case over 7k).

The sad part is that is the offer I made to them from the start. I think their attorney was expecting me to be difficult. I could have been, but I am not like that. Hopefully their attorney is a friend of theirs and not charging them.

I also expressed to their attorney how sad it is that I had to file a suit for this and that a non attorney without the means would be just told to beat feat and that is not acceptable...
