Honestly, go wherever your money spends better even if it is a $500 cost loss upfront. They will not be losing money having to put your vehicle on the lot and selling it.

Honestly think it's a douche move to back out of agreement because you found something that fits the bill a little cheaper. Whats your word worth? We bitch moan and groan when dealerships change stuff on us (and its wrong for them to do so) but then you want to go and do it AND want to get your deposit back??? These days, with what dealers have been selling these for, I don’t think there’s an aggrieved/harmed party if OP back out of the deal.

Unless OP spec’d out a complete turd that’s just going to sit on the lot for eternity. Even if that’s the case…slap a Mopar lift on it, 35’s, and Rockstar rims and someone will take it.?

That dealer can probably sell it for more than OP was lined up to pay once it’s sitting on the lot.

That being said…someone would need to have a pair of brass ones to back out of the deal and demand their deposit back.

Lol. Yup. If I was them, I’d put that $500 toward the labor cost of installing the mall crawler kit that’ll be required to get that off the lot.

Words and handshakes aren’t binding in today’s business world.
However unfortunate that may be.

On the surface I agree with you. Part of me though says that dealerships by and large created the adversarial relationship of car buying to begin with and is not standing on a moral high ground for things like this.

Look through the threads on Extended Warranties. I would definitely get one (Max Care) if you decide to go used. Unless you're able to contact the previous owner, you never know what you're going to get. It could be someone was just trading up, and it could be a problem someone was getting rid of.

I would go whatever way makes sense to you, personally i have not much respect for dealerships. i have put deposits down before only to show up and they vehicle has been sold to someone else. i have ordered a vehicle and once again, watch it go to someone else because i was at work. they wont have a issue in this market selling it to someone else. i mean we were replacing a vehicle the other day. went to a dealer and looked at it, and when they went to copy my license for a test drive the sales manager ran out and put a 4k markup on it while i was inside getting my license copied.

if you do go used the mopar extended warranty is a smart move.

Thanks for the advice, as far as an agreement on my preorder. All I really have is a price breakdown of it, that shows my $500 deposit. From what I can see there is not commitment to actally buy it, this is not a "sale order" or contract.
The used gladiator I am looking at, the dealership has a 24 hour test drive policy. I was going to bring it home and drive it to work the next day. In all I'll get about 100 miles on it in that timespan and get a chance to craw all over it.
It's Carfax says it's from Florida, and it was purchased new in mid 2021. The way I look at it, there can't be all that much wrong with it.
One possible issue with Florida trucks is if the possibility that the owner drove it into salt water on the beach. People that tow boats down there often get their rear wheels into the water, which corrodes things quickly. Check the undercarriage thoroughly.

Which will be a hard sell. No payload, no towing capacity, and of limited audience these days.
Most on the lots will be middle-of-the-road vehicles. Not fully optioned, but not stripped down sticks, either.

Yup - years ago I sold a house myself, no realtor, just had a banker advise (for free) and an attorney look at the document I made (for a small fee - honestly, it was small)

A woman came in and looked and said she wanted the house, I handed her the document and told her to look it over and if it was ok, there was a deposit required.
The next day she changed her mind and wanted her money back.
Sorry, to avoid a hassle of people doing that sort of crap, I made it non-refundable.
She threatened to sick her attorney on me - ok, bring it on.
Her attorney agreed - the document she signed was very clear in the amount and that it was non-refundable.
You get too many people like that - all excited, yeah, I love it, I really want it - then later want the money back.
I grew up learning that EARNEST money was just that.
IMO, otherwise, what the hell is a deposit for if you can change your mind and back out any time you want and get it all back?
It proves nothing these days. It used to prove you were serious and fully intended to follow through.

Words and handshakes are absolutely binding from an ethical perspective.

Legally, you are mostly correct.

The dealer may be happy to hold onto that truck as inventory. I'd simply have a discussion with the dealer. They may or may not give the deposit back. Either way, figure that into your calculations.

Your spec isn't very desirable, and they'd likely tell you to kick rocks and keep your deposit - but that's really about it.

My truck that is on order is exactly what I want, and to be honest I can get the same or better deal immediately nearby if I sacrifice color, or an option, or whatever - but I paid my deposit and ordered exactly what I want (hydro blue isn't super common, and combine it with Max Tow and its nearly rare). They told me I'd eat the deposit if I back out because then they have a truck that doesn't fit the bill of what they typically order to sell quickly (and based on what is on their lot, I'd say that sounds right). Anyway - this is a dealer that I bought my JK new from back in 2016, a close friend of mine buys all of his Jeeps there, and they generally support our local Jeep club when we ask - so I'm inclined to not create bad blood. Always been good people - and my truck will be a few percent below invoice - so that's cool too.
