I'm not making any statements... just responding to what I'm reading...
Yes they can not bar your objection. Hence the suggestion to getting actively involved. While they cannot force you to accept any form of work or quality, or force you to accept higher cost new parts or reduced cost used parts, they can and do leave the insuree out of this direct line of communication. This is the standard approach, beyond declaration of it being totaled or repaired, the insuree is not going to get a fully itemized account of the adjusters appraisal unless upon request.

This happens without insight, its not overt in the "you'll take what we give you sense", its covert in the sense that "we'll get it fully repaired" while telling you nothing about it beyond what you inquire about on your own. I've lost 3 vehicles now and have had other accidents as well. This is only coming from experience and an effort to help others where they may not be as experienced.

The fact of what can legally be allowed or not does not factor into the actions they take if the owner never objects because the owner never knew. I've also had friends in the auto repair industry, this isn't uncommon.

Good luck.

Very good advice to get involved if you disagree with what's going on with your vehicle, but I also want to point out that experiences can differ. In my case, my insurance company (State Farm) provided me with a copy of the itemized appraisal with part numbers, vendor sources, and labour estimate before any actual repairs were started.

The path from where the other car stopped to where my skid marks are on the HWY.

They do differ case to case, for example I also have SF, in the case of the Tundra I had to pressure with the help of the body shop to actually get them to opt for the use of new parts. Ironically in my case SF did not know I was discussing with the shop and the shop was agreeing with the perspective that totaling the truck would be responsible given the damage. The shop released the appraisal order itemized with the options ordered by SF, that included used bedsides, used frame, used tail lights. The choice was made because the bedsides were 50% the cost of new and the frame was around 70% the cost of new. With that delta they could clear the total loss threshold and that would allow them to close the vehicle claim sooner. Each time I've worked with a insurance agent at SF has been different, I've had convivial and enjoyable experiences and I've had one where I was T-boned, at a camera intersection, with CCD evidence. The at fault waited the full 3yrs to respond, as it the limitation in our state. Once they did it was incoherent to the case at that point. At fault was intoxicated and recorded running a red light and hitting me. My agent opted no contest to 50/50 settlement and informed me after they made the choice. At 20yrs old I did not have anyone to lend me any advise or perspective, so you can imagine I'd hate to see that happen for anyone else.

I never implied my advice or perspective was the standard, but rather worth consideration. "Luck is when preparation meets opportunity", passive participation is not preparation, YMMV and all our goals are individually our own, mine was only in hopes that the OP doesn't get screwed, not to mislead.

That’s scary! Hope you’re safe. Usually at that speed, they’ll check if the frame or major components are damaged could be repairable, or might be totaled. Tough call until it’s inspected.

Glad you’re ok. I’d be surprised if they fixed it. It looked like a bent frame before I even got to the frame pics.

I'm just supremely pissed off this guy was traveling at 130mph speeds. I'm not the type to go after someone and sue but this is a 100k car he was reckless to say the least.

Wow…..wow…. You’ve got some luck on your side or someone watching over you. That could’ve been soooo much worse!!!! Better start praying and saying Thank you to whom-ever you’ve been praying to!!!
(**and I’m not a religious person)

I didn’t read thru all the messages….. did the airbags go off?

To be honest… and no offense, you probably want the truck to be totaled.
Replacing a frame is a huge job and the truck won’t be the same after they get it back together.

Back in 2003, I was in an accident on the highway. I have two titanium plates in my head from it. Crazy…… and I was just sitting stopped in traffic when it happened.
