This frame is definitely bent.

Obviously. There’s not that much flex in the bed without doin the frame. Ooh. But it’s behind the axle? That’s not really “frame” for the purposes of making it drive right.



At least it was a rear collision. The only collision you can at least most of the time say was not at all your fault.

States don’t have anything to do with totaling a vehicle…. Maybe there’s some weird exception somewhere. Strictly a business decision by insurance.

I’ve seen a lot less effed up trucks get totaled…. Frame involvement is usually a can of worms they don’t want to worry about.
You are right and wrong..........
While that's generally true..........States often control what insurance companies do. Each state has their own rules. And if in your state the insurance company will not total your vehicle and yet it meets what the state sets out as a totaled vehicle, you can go back and say yes, the state of xxxx says it's totaled. It matters for salvage titles and other things.
If the insurance company won't total the vehicle, you can sue and depending on the state, you may have some leverage (see below for Iowa's rule)

Armed with that and diminished value, you can often win and get a vehicle totaled, DEPENDING (and on the state as well)

This from an attorney specializing in such things -
Of the 50 states, 22 leave the total loss threshold up to the insurance companies to define (with some qualifications), while the remaining 28 (and District of Columbia) define set thresholds.

So this is one of those things where there is no one single answer - it depends on where you live, your insurance company and other factors. You can present facts and figures and negotiate - even convince them in many cases, in extremes, you may be able to sue. And using diminished value plus estimates from other shops - you may win (or not)

One of the crumple zones, perhaps. I'd bet that's not the only spot.

It's your truck...... but if it was mine I'd be going over it with a fine-tooth comb and looking at every single body mount, look for leakage (hydraulic mounts on these) and other suspension points, anchor points for everything, including engine mounts. Impacts put the rules of physics into play - objects with mass when at rest want to stay at rest so if the frame is shoved forward and the engine wants to stay put - things can get messed up, including axle tube damage and transmission case cracks. Look at where the axle tubes go into the cast differential center housing, things like that.
Maybe nothing but you don't want it repaired only to find trouble in 6 months after you've settled and signed the papers holding them harmless of any future claims.

Yeah, saw that, so posted this in one of my first posts here -

In California, it's If the total cost of repairs plus the salvage value of the vehicle is greater than the vehicle's actual cash value, it's considered a total loss.

I don't know if CA controls this or if they freely let the insurance company decide. That's your baby to run with. But that's what CA's AG says about it anyway. What happens is up to you - and you working with the other guy's insurance company. I know in a case I went through years ago the other party insisted it wasn't their fault - my company paid and then joined with my lawyer to get the other company to pay up. In the end they paid up and my attorney got a nice sum. They shouldn't have argued with me, I guess. Sounds like your case is cut and dried as far as the other party admitting guilt and who will pay. But your insurance company MAY want to be involved all the way, too - up to them and you obviously.

I feel your pain. I had my 2022 Gobi wrecked by a red light runner last Saturday. Thankfully my kids and I are all healthy and walked away with only minor bumps and bruises. My Doctor did find some whiplash in me. Please ensure you are checked out as well if in a accident. Sadly the driver that hit me, had no insurance, and listed a homeless shelter as his address. My insurance is good, however awaiting word on what they will do. Regardless I have been totally bummed out this week. Especially knowing that Gobi tan is no longer offered on new models. I only had 9300 miles on it, and only 11 months. Had two more adventure trips planned in August which are now cancelled.

OOF! Sorry for your losses. I use stories like these to remind myself that riding a motorcycle in traffic requires paranoid levels of awareness. The old saying rings so true to me even after 20+ years of riding. "He was right. Dead right. But he is just as dead as if he'd been wrong."

My son got rear ended in his F-150 by a small car and the bed/frame wasn’t as bent as yours. It was totaled and hopefully yours will be as well.

The good news (if you can call it that) is that you can probably negotiate for a better price on a new one and not have any out of pocket expenses.

Have you gotten a loaner yet since your JT is undriveable?

After sleeping on this one, my recommendation is to let YOUR insurance handle this one. You pay your deductible and let them deal with the repairs and related issues.

Once it's all said and done, your insurance will subrogate the other side, get your deductible back and you'll be made whole.

In only one case have I let the other insurance company handle a wreck and it did not turn out in my favor as they were underinsured.

The other side is all smiles and roses now but they have their interest in mind not yours.

It's just business.

Bummer thats exactly why I hate Fords???? on the serious side I hope your all ok tge Jeep can be replaced.

We are a two car family and I don’t have a need to drive now as I am injured. Tomorrow (Monday) though will be another day.

I was rear ended some years ago by a driver with a suspended license that had the same insurance company as this one and they were very dismissive and indifferent. Our insurance said we are to file a claim with the other insurance company. What the hell do we pay our agent for? Monday will be an interesting day. This is not something I’m looking forward to.

I was rear ended some years ago by a driver with a suspended license that had the same insurance company as this one and they were very dismissive and indifferent. Our insurance said we are to file a claim with the other insurance company. What the hell do we pay our agent for? Monday will be an interesting day. This is not something I’m looking forward to.
Happy to hear that you are ok (for the most part). When dealing with the other insurance company, just remember, YOU did NOTHING wrong! If you aren't happy with what they offer, as much as I hate to say it, talk to an attorney.
