I would go with the 5, no point in having them stick out more than a little beyond the fenders

I have 37x12.50x17 on my JT with 4.5” BS and the Evo 2.5” overland lift. I scrub on the lower control arms at full turn during normal driving. I’ve been thinking of running 3.5” like I do on my JK.

If you are planning on a lift in the future, many recommend no more than 4.5" backspacing. If you aren't doing more than a simple lift at most, it's all dependent on how much you want your tires sticking out and the greater the backspace, the less will peek.

I already have 35x12.5x17 bfg’s on stock wheels but want to buy new wheels
You should be fine with either one, so it comes down to preference. There’s a 12mm difference in where they will sit in the wheel well. Here’s what the 5” backspacing (+12 offset) would look like.

If I ever buy aftermarket wheels, I will likely go 4.5 for mine.

With an 8 inch wheel, what's the maximum amount of backspacing we can handle before we have issues with rubbing on the inside? I live in Pennsylvania, so the tires can't stick out at all legally. So I'm trying to ensure the tires stay tucked, and want to give myself a range to work with

Backspace is a universal measurement so there's absolutely no difference for inside rubbing between any wheel width given a particular backspacing. Stock wheels are 6" backspace (+44mm on a 7.5" wheel) so I'd probably call that a reasonable maximum. You could probably do an extra half inch if you have the wide axles.

Check out AEV wheels they are +25 17x8.5 will fit 37” tires with one of their lifts or similar. One issue people run into as mentioned above is some lift kits that replace the control arms use straight control arms which with stock or close to stock wheels and wider tires will rub the control arms in tight turns as they do not bend in like the oems.

It depends on which trim you have, and what size tires you will be running. Nothing is absolute.

Rubicon trim. I'll be running 35x11.5r17 or 35x12.5r17. I'm leaning towards 35x11.5r17 to be on the safe side here. I don't want to spend my hard earned cash to get a fix it ticket
