Completely justified. Driver was running from an LE vehicle running Code 3. Active resistance. If it took 2 attempts to PiT the vehicle, that’s a further resistance level. In this day and age, a DUI doesn’t have to be just alcohol. With just 2 Officers on scene cuffing from the prone was the safest option for the officers and the public.So I looked at the video attached...wonder why they had him face down and two officers to cuff him? I did a few years with the CO CSP and never had to do that with a DUI.
When you have a drugged up suspect pinned in with 3 vehicles and they STILL try to run by ramming a police vehicle you start to understand that fit has hit the Shan and you never know what’s going to happen. Better safe than sorry. I would have handled this in exactly the same manner.
