I have been reported for "alleged " brake checking. Of course the cop will try to get you to admit to brake checking. "I'm sure the dog owner that still has a dog because I slammed on the brakes appreciates it more than the dumbass that must have been following too close?" No citation, no judge, just a friendly "have a nice day and watch out for terrible drivers". Quick Google search says "brake checking is illegal and can lead to partial liability. However proving intentionality is critical. It must be proven that the braking was done maliciously and not the legitimate reasons". I don't care if it's on dashcam video, the only way to prove malice is your own statements.

Justify it however you want.

I still recommend not brake checking. I’m not going to do something that could cause someone to rear end me. I tend to do the opposite.

Braking for a dog isn’t brake checking, so I’m not saying I wouldn’t brake for good reason.

I'm not recommending anyone behave like I do. I'd also recommend not tailgating as you never know who's in front of you.

There’s no reason to brake check on rural roads. Just slide slightly over towards the shoulder. Those MTs are pretty good at picking up rocks, or so I’ve heard….. :angel:
And swerving for deer causes more deaths than hitting the deer.

That's why everyone who owns a 4wd should come play in the desert. Knowing how your vehicle will react to transitioning from pavement to dirt at speed, cornering on low traction surfaces at speed, and even large bumps and/or jumps can be life saving in real world everyday driving.

Go to the other guy's insurance and let your insurances duke it out. And always call the cops. Make them actually be good for something for once. Driving off from an accident is an offense in some places.

As for your damage, this is an opportunity. Yeah it sucks this happened but your damage is minor and maybe now you can look at some mods.
As a former LEO, in part I take offense with your reply. But on getting it documented I'm 100% agreement . Police documentation and assessment is crucial. I've done thousands of MVA reports, more than I want to remember. A reason I changed my own insurance from USAA is due to the b.s. I've been though ridiculous price insurance cost due to crashes and my experience when my Wrangler Unlimited got "stripped" by thieves many years back. Slight O.T.
On topic:
Get multiple assessments for repairs and talk with USAA insurance document everything keep log of what said too.
