I have been reported for "alleged " brake checking. Of course the cop will try to get you to admit to brake checking. "I'm sure the dog owner that still has a dog because I slammed on the brakes appreciates it more than the dumbass that must have been following too close?" No citation, no judge, just a friendly "have a nice day and watch out for terrible drivers". Quick Google search says "brake checking is illegal and can lead to partial liability. However proving intentionality is critical. It must be proven that the braking was done maliciously and not the legitimate reasons". I don't care if it's on dashcam video, the only way to prove malice is your own statements.Tell the judge.![]()
