Some states do use that process - if you could have possibly avoided the idiot, but didn't, then you are at least partly at fault.
This applies mostly to injuries in an auto accident, but don't think for a minute that you can't be held even partially responsible for an accident - if you could have avoided the idiot.
Here's an example -

Comparative Negligence
Joe and Bob are involved in a car accident.
Joe was traveling at the speed limit when Bob ran a red light and hit him.
In this instance, Joe would be deemed partially responsible for the accident due to his failure to take account of changing traffic conditions or slow down before entering the intersection.

Bob, on the other hand, would be found primarily responsible as he ran a red light and caused the accident.

Using the concept of comparative negligence, a court might find Joe to be 40% responsible for the accident and Bob to be 60% responsible. In this case, Joe would only be able to recover damages from Bob for up to 60% of his total losses.

This is a fact - look it up. It varies with states - some are NO FAULT states, others not so cut and dried. Florida is a comparative negligence state when it comes to medial/injuries.
Some are that way even for repairs.

My brand new 2017 JKUS got hit 16 hours and 50 miles after I picked it up. 11 weeks in a repair shop with 23,000 in repairs. Seemed minor but required a new frame. Be sure to insist on a Jeep certified shop, loaner, and diminished value. The extent of frame damage was hidden until they were well into repairs.

I unfortunately understand your pain. I was t-boned as well oct 2022. got my truck back Feb 2023. Had to wait on parts. They had to replace a portion of my b-piller, rear door and hinges, rocker panel and rock slider.

hopefully if they can fix it, it doesn't take as long as mine did. however I am happy with the work they did, when i got it back couldn't even tell it had been damaged.

Hey guys..appreicate the kind words. Good thing is other party was also with Geico (same as me) so they are handling it. Fault was determined to be other party....I feel sorry for the kid though..appears she just got her license 2 months ago and is a high-schooler. I was able to her Drivers ID later since I had her mom's contact info.

Dropping mine off on Monday to a Geico approved shop. I read their reviews and it seems legit. They've worked on RangeRover/Mercedes as well and offer lifetime warranty on the repaired parts.

BTW, this is what Geico adjuster qouted me (parts only) (About $4k in damage inc labor and no deductible on my end so happy with it). Hopefully I can get it back in a week or so.

Mine was backed into by a fully loaded tractor and trailer at a fast speed. It pushed it 2 feet back and pinned it against the curb. 3 months later and $11,500 of repair. It looks perfect and drives great.

Avoid the cut rate body shops (caliber, service king and the like) as they work for the insurance companies….not you.

Find a reputable independent shop.

Diminished Value Claim. Look it up, and make sure you get something from the insurance. On a new vehicle, this is a big part of the financial damage.

My kid and I were returning home last night from a local park and got T-boned by a speeding 16 yr old (no drivers license on her either). I was driving but was able to control the impact as the glady swerved off the main street but the 33's went right over the curb and onto the footpath like a champ. I haven't taken this for off-roading yet but this was a nice welcome test :(. If it was any other vehicle, the rim/tires/lower body would probably be destroyed from the curb. The Glady took this like a champ.

My son was on the passenger side where we got hit but even at that high impact, both of us barely felt any jolts. This is all the damage we got while the other car's front end is totally gone. Might be totaled. After exchanging the insurance details (had to get the girl call her parents to the accident site), I drove back home....the other car had to be towed.

Kudos to the Glady for being build like a german tank! Still working with my insurance on the repair.

I haven't been in a car accident for over 20 years so this one certainly jolted me. Any advise on the repair ? Should I request the insurance to replace both doors/fender and the rock rail is slightly bend. However, both doors open/close fine inc remote locking. I'm surprised this is all the damage the Jeep took from a speeding car. No warning lights or anything on the dashboard and vehicle drives totally fine.

VERY glad we were in this and not our expensive IX (with low profile tires so it'd have hit the curb and basically exploded).

Irony is I haven't even received my 1st payment yet :( (wipes tear from my eye). Still 400 miles and I was looking forward to driving this everyday since I work remotely from home.

Hopefully, the repair comes out well.

Well it looks like there's going to be some hidden damage. Make sure the body shop repairs using oem parts. Also make sure they pay you deminshed value because it will hurt the value. Glad everyone is ok

UPDATE:

Dropped my truck to the collision center this morning. Was surprised Geico coordinated another Gladiator as replacement for the rental (It's a gasser overland trim) at no charge.

And of course, the replacement came with the infamous Jeep chipped windshield free of charge ;). Rental company made a note of it and said if it gets bigger to go back and exchange it. Apparently, this vehicle is already on its 2nd windshield (and already chipped..lol).

Repair shop adjuster flat out said they'll need to order 2 replacement doors from Jeep (oem) and will contact Geico for a re-adjustment on the original quote Geico had written up. The center pillar has to be replaced as well plus the rock rail. I'll know the real quote by tomorrow when they take apart the door panels today.

I already ordered Rough County side steps before the accident and the shop adjuster said they'll put it on for free since they'll be removing the damaged rock rail anyways. Bad news is it might be in the shop for up till 3 weeks (vs one week that Geico had written up).

But I'm happy I got another glady to drive around till then. First thing I noticed is the gasser is SO much quicker than the turbo lagged diesel. And the ride is super quiet and smooth with the all season tires (vs the 33 mud terrain on mine). Though the 16mpg average milege means more fillups but I work from home so not concerned!

My "new" temporary ride:

One week for that damage is a crazy estimate anyway. My WJ was one week for rocker panels and you need more than that for sure.

Overland should do a whole lot better than 16. Mine gets 18 the winter and 20+ in the summer, depending on the wind.
And I'm running A/T tires.
With the stock highway all-season tires, I was doing 21-22.
I can't imagine an Overland getting under 18 unless hammered really hard.
It's made for MPG.

This is true. The only way you can avoid having fault assigned to you is if you were not moving.

I was leaving a parking spot at a AAA office when a knucklehead veered into me.

We both had AAA insurance and they tried to assign some fault to me as they assumed I was moving at the time of the collision.

I informed them that no, I spotted him coming my way and stopped....and had the dash cam video to prove it.

With that I was safe.

So, the lesson is have a dash cam, and stop before impact if at all possible.
