That proves nothing in regard to Affiliate Pricing. It shows that you put a deposit down. There is nothing stipulating agreed upon price for the vehicle. By failing to obtain a written agreement essentially you are accepting MSRP/at the mercy of the dealership.
FCA affiliate pricing is governed by Jeep not the dealership. Them verbally saying that they are a dealership that is partnered in the affiliate program means exactly that. Since jeep retroactively banned the gladiator from the affiliate pricing, they arent able to apply the code on the truck since. There was no reason to get any of this in writing. They are an affiliate partner and on april 3rd the gladiator wasnt excluded. Part way through paying for something and then jacking up the price is shady at best. Since there is nothing in writing, I can always get my money back and take it to another dealer, hence why I made this thread to try and see about getting the LE sent somewhere else.

Truthfully, the dealership can still sell you the vehicle for under invoice pricing. They can actually sell you the vehicle for any price they want as it is their choice as to what they want to make/lose on the vehicle. I would assume whether the vehicle is FCA affiliate eligible only comes into play with reimbursement from FCA to the participating dealership. I actually switched my LE from my local dealer to one 50 miles away because the local refused to put in writing what we had agreed to the day before verbally. I ordered on 4/4 and made sure that there was no "qualifying" language, just the sales price (FCA Affiliate) less my deposit to show balance. Now, it is between FCA and the dealer since at the time of the order, the Gladiator was not exempted.

In your scenario, if you are in KZS, I doubt it can be rerouted. I would recommend contacting your Better Business Bureau and letting the dealer know you will be doing the same. From a document standpoint, they have to have your Order Sheet and Build Sheet available. Many of the LE window stickers that have been posted here show Built for "YOUR NAME". Get those documents. I agree with the others that none of this guarantees you will win a case, but putting some pressure on the dealership cannot hurt.

And this is why I started this thread. My jeep hit KZ status on saturaday so I was trying to find out if anyone had any experience intercepting a shipment to go to a dealer that would "honor" the pricing regardless of if Jeep would or not. I already spoke to Jeep concierge and Jeep customer care about it all yesterday so they put a ticket in for me and said that would call me back on Wednesday.
Let us know what they say. I still stand by that you should ask for your order to be canceled and go elsewhere, disputing the credit card charge if necessary, unless you are super duper stuck on taking delivery of this exact Jeep.

Do you have any proof that the gladiator was ever listed as an included vehicle? You were already proved wrong about the gladiator being on the excluded list in your thread. I don't think 2020MY Jeeps were ever listed as included in the FCA affiliate pricing. Dealers just assumed it would be.

Yes, they did print me out the "congrats on your new gladiator purchase." And all the concierge details/reservation form.

I don't think it was ever included was it? The Gladiator was always a 2020 MY. There still is not a list of Eligible models available for 2020 MY, even on the current published terms. So no assumptions should have been made there. If they gave him something, I don't think it was the actual terms and likely a dealer error.

There is nothing he signed that stated his deposit is nonrefundable, however -- so he can just get his deposit back from the dealer.

Well, they certainly 'explicitly' marked it as excluded after it was for sale, but they never 'explicitly' included it either. So no wrong on their part.

However, if the dealer told them it was available, we know how that will play out.

I'm sorry but your argument has no merit.

FCA did not retroactively end AP. They never stated that it was offered.

In your own words you stated that the dealership claimed to be an AP partner. If FCA is not including the Gladiator in AP there is no partnership in regard to this purchase.

It would be nice if the dealership would honor the price, however they are under no obligation to, there is nothing in writing. Either buy the jeep at whatever price you can negotiate with them or ask for your deposit back. Depending on your state's law they may or may not return it.

Again, no proof it was ever included.

On April 3 the gladiator wasnt included or excluded... Because it wasn't a vehicle that was for sale. (Yes, some people did order LE's that evening but that wasn't supposed to happen until the 4th)

Everyone is missing the question it seems like. I am not trying to force them to do anything. My ultimate question was intercepting the shipment and sending it to a dealer that would "honor" it regardless.

And that is why I said dealer X. I was trying to figure out why and then ship to a dealer that would. Chance posted the rules sheet that Jeep updated a week after my pre order. So while other dealers are able to sell at discounts, mine wont now because the negotiation was using the FCA affiliate pricing, not a one on one haggle with the dealership themselves. I was content with invoice -1% and didnt feel like haggling beyond that.
I am not trying to smear this dealer, our agreement was FCA affiliate pricing. Jeep pulled the rug out from underneath me and I am just trying to figure out now how to still keep my around invoice -1% by taking it to say spirit lake inn instead.

I think everyone is trying to get you to understand your mistake, because you keep making it sound like it's everyone but your selfs fault that you're in this situation.

No one pulled a rug out from under you. There never was a rug. FCA never said they were offering affiliate pricing on Gladiators. Never. Not once. It was never on any list as an included vehicle. You negotiated your deal on the assumption that it would be added to the list, but it wasn't, and now unfortunately your dealer won't bend over backwards to help you out, but they shouldn't be required to either. You're most likely going to have to walk away from your deal and place a new order if you want a break on pricing. I don't think you will have any luck transferring your order to another dealer.
