How much weight do think is being towed in that picture?
Not sure how much that trailer weighs, can't see enough of it to tell, but a CJ 5 weighs about 2300 lbs. So if that trailer is 1200 lbs, then it's right at the stated rating of 3500 lbs.

It definitely is purposely underrated on paper (official specs). The JKU can tow well over its 3500 lbs official tow capacity. I've seen a friend tow a Ford Bronco on a hauler across Washington in his JKU Rubicon w/ 6 speed. The Bronco weighed about 4200 lbs and the Hauler about 2000 lbs. That's 6200 lbs!
The 3500 lbs limit could be cuz Jeep only rates its hitch as Class II - meaning maximum of 3500. This might be because of the way that the hitch mounts to the rear frame cross rail and not to the side rails. O could just be a CYA # to prevent lawsuits.

Likely not due to mounting point, the export Australian Wrangler has the same mounting spot, and it's rated for 5,000 lbs, and the Euro one is rated for 4,840. Both have bigger brakes and the diesel, but even the Pentastar is rated for 4,400 lbs.
