Stuff like this just does not happen out in the ether. It happens because people have been skirting the laws for decades with a wink and nod when most knew eventually a day of reckoning would come when the laws actually get enforced. It is a lousy "Defense to Prosecution" to now argue it should not be enforced because it was never or hardly enforced in the past.
For the record, I do not necessarily agree with it but understand how we are in this situation to begin with. The solution to change it is a political one.
