Hello,

We were dead stopped at a red light and were rear ended by a drunk driver. There were no signs of braking and unfortunately the driver was heavily impaired. Thank God we all walked away without injuries.

I have filed claim with the DUI guy's insurance company.
Does anyone have any tips on how to navigate this dealing with their insurance company? This is first accident for me. I am concerned with frame damage and just want to make sure I cover all my bases upon repairs.

Thank you for any and all advice.

What disappointment.
If your insurance agent/agency won't help with your claim, find another insurer.
That is why we pay the premiums.

Happened to me on my previous blue Jeep J10 back in the 1980's.
Is that why I chose white this time instead of blue?

First of all, glad you walked away from it. Jeeps are repairable, people are harder.

Agree with the others, let your insurance company fight for you. If your Jeep is repairable then you need to take in to account for the "Diminished Value" of your Jeep after it's been in an accident, repaired prefect or not. Toss that phrase into google and do some research, your insurance company may deal with this for or they may not.

Have you verified that the drunk had a valid insurance policy at the time of the accident?

Shoot I forgot....are you in a no fault State? I'm only speaking from California perspective. Not sure how Nevada laws work but hopefully that all goes out the window on a DUI.

It is not, it is "at fault" state

  3. Be sure to also go after them for diminished value, should be able to find some guides online. This is additional compensation for the reduction in value for your vehicle having an accident history. As you might imagine, insurance companies do not like this and will fight it hard, but you are entitled this so don't give up.
  4. Fuck that guy.

You got hurt. You may not have felt it right away but you will. Don’t sign anything. Your insurance company will fight for you and get what’s fair for you and will discuss what’s being negotiated. You should have massage and chiropractor visits in your insurance plan. Soft tissue damage is a real thing. Glad you walked away.

Rear ended? But an F N DRUNK! Especially if charged at the scene! To help be sure you’re made whole? I would start complaining about neck and back pain! See a doctor about it and persist, heck win an award for acting! Then whatever they cheat you in repairing the damage, or total replacement with no out of pocket expenses? The other driver and insurance company will still get off easy compared to if you were or other innocents were killed. Truck driving is the worst, especially if not their first!

Do Not Sign Anything until you are sure about the damages, both to your vehicle and more importantly, TO YOU. Not to sound like a vulture (lawyer) here, but a small ache or pain that you overlook now may cause you more problems and money in the future to have it treated (think about something as simple as using a keyboard or mouse at work or some task that may seem second-nature now).

If you were were in FL, I would recommend one of the vultures that advertise specifically for these types of accidents. I am not sure how Nevada works. But again, take you time and it may be in your best interest to speak to a couple of attorneys BEFORE sighing anything.

It amazes me how the plastic rear bumper can take a hit. I'm sorry for your first vehicle crash. I've had a few over the years and it is never easy.

It takes a couple days before you feel anything, usually.

Do you know if Nevada has a "make you whole" law? Basically, repairing the truck and paying any medical doesn't "make you whole." Pain and suffering, diminished value, PTSD, etc.

In 2010 the 'pre-wife' & I got rear ended. Short story - After a couple years of treatment and surgeries, the settlement in the low 6-figures was whittled down through lawyer's share, employer's self-insurance payback to a very low 5-figure take home.

In 2017, WA state passed a law that injured parties have to be "made whole."

Damn that suck. Sorry to hear about it but glad you’re ok.

I also couldn’t help but notice the price of diesel! I just paid $2.95 a gallon yesterday here in Oklahoma.
