Does sending my truck to the collision center mean that I have accepted delivery? Just a different address? I'm not sure if it's Montway file insurance or carrier file insurance.
you can meet at the original location and sign that you DONT accept delivery and take pictures. then they have to deal with it. or you can have them, take it to Montaway but you'll still have to sign that you don't accept delivery. regardless of what you do, DO NOT ACCEPT DELIVERY.

I’ve never had a vehicle totaled out.. especially not like this. It must be devastating emotionally if you attach yourself to your vehicles like I know I do.

It’s your turn to grab insurance by the balls and make them pay. The truck was in their possession and they are 100% liable for the damage. This might take a minute to resolve, but at least you know it will need to be resolved.

I wouldn't accept shipment and I wouldn't tell them where to drop it off. Just in case that constitutes acceptance in your state. If you own the vehicle and have it insured call your insurance company and have them tell you how to deal with it.

This. Insurance companies bend us over all day long, do not accept anything less of making you entirely whole. You should not be out a single cent including all modifications done to the vehicle.

If YES........ This is NOT your issue and this truck officially belongs to the dealership and NOT YOU.

I can't say this enough...DO NOT ACCEPT this truck - EVER.

As much as this sucks.....Tell the dealership, you demand that they build you another truck - You're paying for a NEW truck - not a repaired one. Don't sign ANYTHING until you get a new truck!!!
In fact, don't even get yourself involved with it.... that's the dealerships problem.

Unless your situation is different....

Yep, to me it looks like OP moved across the country and opted to ship their vehicle rather than drive it.

If this were a dealership type transaction, the transport company would not be contacting OP, they'd be contacting the dealership.

It’s dead Jim, and you wouldn’t want it even if fixable.

If you took delivery, and signed papers, and had it shipped, then it’s an insurance issue not a dealer issue unfortunately.

Throughout the process keep in mind that this isn’t on you, it’s entirely the shipper’s responsibility to make this right with you, and quickly so. Since settling this could take a couple of weeks and if the wreck caused you to have to rent a vehicle until this is finalized then they’re fully responsible for any rental fees as well. Good luck.

This!!!!! contact the shipping/carriers companies insurance…and contact yours to get them involved they have attorneys that will help you. do not have them take it to a bodyshop, that classifies as acceptance of delivery, having worked in freight, ask the shipper and carrier for the DOT Police report for the collision….. if one was not filed ask why, and get in writing the response, if they did not get a report it’s going to help you because it’s going to put the blame back on carriers insurance, it will also put the driver of the truck at fault and launch a DOT investigation. which will help you more than shipper or carrier, and a lawyer will rip them to shreds over it.
