Just bought a 2022 Gladiator Rubicon Diesel with 20k miles in Oregon at Grants Pass Toyota. Drove it for about 2k miles since Dec. 22 and yesterday, 1/3/2024, it failed smog in California. The cycles are not completed. I would have thought it would have completed by now. The Toyota dealership did replace the battery and removed the Tazer that was in it. I never got the details about what, if any mods were left by the Tazer, or if they're even able to remain once the Tazer is removed.

At any rate, is it legal for Oregon dealer to sell me a vehicle that is 50 state legal, yet doesn't pass smog in California? What do I need to do to get it to complete the cycles? And is it ok to clear and reset the codes?

You should still have the warranty from Jeep. Think all manufacturers emissions warranty go for 7 years.
Why did they take out the Tazer? The Tazer would have nothing to do with emissions/ECM. Maybe gear and tire ratios are off causing the problem?

Take it in and have the dealer fix it. Last I looked the emission warranty is 8 years, 80,000 miles. Easier than trying to screw around with the dealer that sold it to you.

The battery was going dead and they couldn't figure it out, so they removed the Tazer to eliminate all possibilities. As far as I know, it's returned to stock. They did replace the battery also.

Next question: Should I just go to Jeep and tell them "it fails smog, fix it" ?
or
Try my luck at completing the drive cycles?

If the Test Station said it needs to complete a cycle to pass. I would think a discounted retest should be offered.
What cycle needs to be completed?
I would try to get the Tazer back from the dealer that took it out. Maybe your speedo is off causing a problem.

I remember reading about people buying a new JT's out of state and not having the monitors reset by the time they made it home to CA 2000+ miles.

Most likely, there’s nothing wrong with it at all and asking a dealer to mess with it will cause more problems and still not complete the self-check cycles that are missing. The self-checks probably got cleared when the battery was swapped. If you just drive it normally for a week, it should complete on its own.

I recommend getting a ~$30 Bluetooth OBD2 dongle so you can read the ready status yourself and not waste time going back and forth to dealer, smog check etc.

I used to have an M3 prone to CE lights, and it was a delicate dance between clearing codes and covering all the driving conditions so the ECU would mark ready to test before the next CE light. (It always tested clean, and it ended up being a sneaky air leak in an intake hose that only leaked when the engine moved under throttle jerk)

FWIW I bought my JTRD new in Idaho and it was ready to test by the time I got home to CA.

And for anyone thinking "smog check" is ridiculous for a diesel, when no smog shop is even capable of measuring diesel exhaust for problems - well yes, but they don't even sniff the exhaust on gas engines any more. It's a glorified vehicle inspection that checks for CE lights and trouble codes and looks for non-CARB aftermarket goodies. CA has no vehicle inspection other than this

You can't reset the codes for the ERT (emissions readiness test) because there are no codes for it, it is simply a test process has to work its way through. Also, if there are any codes and you do try to clear them, it will likely reset the ERT again, just like swapping out the battery did and you'll have to start from scratch. You can look in your manual in the " EMISSIONS INSPECTION AND MAINTENANCE PROGRAMS " section and should find a quick procedure to check if the ERT is cleared yet.

Also, it's important to know exactly which tests for the ERT are not complete. Get the OBD2 reader as mentioned above. I've run into this before with California smog shops. For example, your diesel does not need to clear all of the tests. Although I think passing requires input from the smog tech, and some are not aware or ignorant. This from the California BAR website...

"Starting in July 2023, the readiness standards for 2007 and newer light-duty diesel vehicles will only allow the Diesel Particulate Filter and the Non-Methane Hydrocarbon Catalyst readiness monitors to be unset."

Depends who you ask
The dealer is responsible for local inspection ETC only for used cars. You should have emission warranty left take it to Jeep dealer.

It all depends on how they removed the tazer if they unmarried it your tire size and speedo will be off. If they just unplugged it just all the live features will not work like auto start and stop and the tire size and will stay at what ever size they set it at.

I purchased my JTOD in Vegas and drove it to California. It had 448 miles on it when I smogged it. Passed with flying colors. I have a feeling there’s something else going on with that tazer system.

Came here to say this, this is the best advice. Don't unplug the battery or reset anything. In CA you can have 2 sensors not ready if I recall correctly. You can ask a 60 day operation permit in CA at the DMV to give you some more time for the sensors to be ready.
